The facts

The Accused was captured on video holding an object that resembled a handgun and pointing it toward a wall. A friend was somewhere nearby at the time, but the evidence never established exactly where he was standing at the moment the object was pointed. The object turned out to be an airgun that looks like a 9mm pistol, firing BB pellets with a muzzle velocity of about 261 feet per second. The friend testified that the Accused never pointed a gun at him and never threatened him. The Accused was charged with pointing a firearm, careless handling of a firearm, possession of a weapon for a purpose dangerous to the public peace, and carrying a concealed weapon. The pointing count in particular requires that the firearm be pointed at another person - and the Crown had to show that on this record.
